Do TOS indemnity promises really protect you?

Think about it: You're using an advanced AI tool, and suddenly you're slapped with a copyright infringement claim. Surprising? Not so much. Who's responsible for the legal mess? Well, it's complicated.

1. AI Vendors: The Good, The Bad, and The Mysterious

Isn't it surprising that in a world advancing with generative AI, where machines can craft essays, create art, or even compose music, the responsibility still lies in human hands?

The Good Samaritans - Some AI vendors bravely step up, pledging to defend their customers both financially and legally should copyright issues arise.

The Silent Observers - Others conveniently have policies that put the burden squarely on the user's shoulders. Are you comfortable with that?

The Enigmatic Ones - We see those vendors, with terms of service so intricately written in jargon that even experts scratch their heads.

2. Beware the AI Copycats!

Did you know generative AI tools can sometimes “mimic and regurgitate” content? Imagine this tool recreating someone else's copyrighted work. Who gets the blame?

Big names like Microsoft, GitHub, and OpenAI have been accused of copyright infringement because of their AI's ability to produce content eerily similar to original works. Feel safe?

3. The Great Indemnity Divide

Wouldn't you expect AI vendors to back their products and customers unconditionally? Think again!

Play Safe Companies - Vendors like Anthropic and AI21 Labs prefer staying in the safe zone, choosing not to guarantee legal or financial support when copyright issues crop up. Ready for that risk?

The Partial Protectors - OpenAI, for instance, limits their liability to a tiny sum or, in many cases, offers no protection at all. How's that for trust?

The Visual Vulnerables - Companies that generate images or videos often leave users in the lurch. Their potential copyright issues are evident. Still want that fancy AI tool?

4. The Few Who Stand Tall

While the list is short, some heroes in the AI industry aren't afraid to protect their users.

Amazon and IBM boldly step up, promising to defend their customers against copyright claims for certain products. But, are there catches hidden in the fine print?

Microsoft dazzled everyone, announcing full legal support for some products under certain conditions. Feeling safe yet, or is there a but?

Adobe assures "full indemnity" for its AI art platform users. However, there's a catch – only for enterprise customers.

5. The Road Less Traveled

Will more AI vendors start offering indemnification as pressure mounts? Perhaps. But what's certain is they won't all offer the same terms. Do you want a shield that's more marketing hype than genuine protection?

Indemnities might seem like the answer, but are they? Over and over, I've emphasized their limits to my clients. Now, before you pick that shiny new AI tool, ponder this: Are you ready to bet on the rewards against the possible risks? Your decision, your destiny.
